
"A common excuse for not investing in a professional (misconduct response) program originates from a flawed belief that “law enforcement should just handle it”. They argue that misconduct is criminal behavior, and criminal behavior falls within the realm of law enforcement, not civilian duty. In a sense, they are absolutely right. When a crime is committed, law enforcement has the duty and jurisdiction to investigate the alleged crime. But a criminal investigation is much different than an internal administrative investigation. Is the criminal investigator going to decide whether or not you should fire an accused employee? Absolutely not. Is the criminal investigator going to face the liability when you decide to keep the employee until the criminal process is complete and something else happens? No. Just as criminal behavior falls in the realm of law enforcement, responsibility for internal misconduct falls to the organization’s internal investigators."
